The Service is exempt from the record-keeping, labeling and inspection requirements of 18 U.S.C. §2257, 18 U.S.C. §2257A and their implementing regulations at 28 C.F.R. Part 75, because it does not produce, publish, host or distribute any visual depictions of actual or simulated sexually explicit conduct.
Why the requirements do not apply
Sections 2257 and 2257A require producers of certain visual depictions (such as photographs, films, videos and digital images) of sexually explicit conduct to verify and keep records of the age and identity of the performers shown. These requirements exist to make sure that every real person appearing in such material is an adult.
AI Smut Generator is different in three ways:
- Text only. The Service generates written fiction. It does not create, display, store or allow users to upload images, illustrations, video, animation or audio.
- No performers. No real person appears in, performs for, or is photographed or filmed for any content on the Service. Stories are produced by an AI model from a user's written instructions.
- Fictional adult characters only. Every character is fictional. Our Content Policy requires that all characters be adults aged 18 or over, and it prohibits content about real or identifiable people.
Because the Service produces no visual depictions and involves no performers, there are no records of the kind described in §2257 or §2257A to create or maintain.
What users can and cannot add
Users interact with the Service by typing text: premises, character sheets, memory notes and edits to generated chapters. The Service does not accept image, video or audio uploads, and stories are private to the account that wrote them. Users cannot publish or share content to other users through the Service. Exports are plain text files (TXT or Markdown) labeled as AI-generated.
Marketing materials
The AI Smut Generator website and marketing materials do not contain any visual depictions of actual or simulated sexually explicit conduct. Images used on the site are typographic designs, interface screenshots or illustrations that do not depict people engaged in such conduct.
Our commitment to adults-only use
Although §2257 does not apply, we take the purpose behind it seriously:
- Every user must be 18 or older and pass an age check before accessing explicit content. See How age verification works.
- Content involving anyone under 18, or characters with childlike traits, is prohibited and blocked by automated checks before and after generation.
- Accounts that attempt to generate such content are closed, and we report to the relevant authorities where the law requires it.
Future changes
If AI Smut Generator ever introduces features that create or display visual content, we will review our obligations under §2257, §2257A and 28 C.F.R. Part 75 before launching those features, put any required record-keeping in place, and update this statement.
